Maine Lobster Now Terms and Conditions
Effective Date: August 18, 2026
These Terms and Conditions govern purchases made from Maine Lobster Now, LLC through mainelobsternow.com, by telephone, or through another direct Maine Lobster Now sales channel.
By placing an order, the person or business placing and paying for the order—the “Purchaser”—agrees to these Terms and Conditions and acknowledges the Maine Lobster Now Privacy Policy.
The person or business designated to receive a shipment is the “Recipient.” “Maine Lobster Now,” “we,” “us,” and “our” refer to Maine Lobster Now, LLC.
The Purchaser represents that the Purchaser is at least 18 years old and legally authorized to place the order. A person ordering for a business or another person represents that the person has authority to act on that party’s behalf.
1. Customer Information and Responsibilities
The Purchaser must provide complete and accurate information, including:

Purchaser and Recipient names;
-
Billing and shipping addresses;
-
Apartment, suite, unit, gate, or access information;
-
Telephone numbers and email addresses;
-
Payment information;
-
Requested delivery date; and
-
Any other information reasonably necessary to process and deliver the order.
The Purchaser is responsible for entering promotional codes, gift-card codes, and other discounts during checkout unless the applicable promotion states otherwise.
When an order is sent as a gift, the Purchaser is responsible for providing accurate Recipient information and for giving the Recipient the applicable delivery, refrigeration, storage, food-safety, and claim-submission instructions.
The Purchaser is responsible for ensuring that the Recipient is available to receive or promptly retrieve the shipment. The Recipient must appropriately refrigerate, freeze, store, and handle the products immediately after delivery.
Maine Lobster Now is not responsible for product deterioration resulting from delayed retrieval, improper storage, improper thawing, improper preparation, or other handling after delivery.
2. Order Acceptance
An order confirmation acknowledges that Maine Lobster Now received an order. It does not constitute final acceptance or an unconditional promise to fulfill the order.
Maine Lobster Now may place an order on hold or cancel and refund an order because of:

Inventory unavailability;
-
A pricing, product-description, or website error;
-
Suspected fraud or unauthorized payment activity;
-
Payment-authorization failure;
-
An incomplete, restricted, or undeliverable address;
-
Product or shipping restrictions;
-
Legal or regulatory requirements; or
-
Circumstances that make fulfillment impracticable.
Maine Lobster Now will not charge the Purchaser more than the amount authorized without the Purchaser’s consent.
If Maine Lobster Now cancels an order after payment has been collected, the applicable amount will be refunded to the original payment method.
3. Cancellations and Order Changes
A request to cancel or modify an order must be received by Maine Lobster Now at least 24 hours before the scheduled shipment date shown in the order confirmation.
Requested changes may include changes to:

Products or quantities;
-
Delivery date;
-
Shipping address;
-
Recipient information; or
-
Gift message.
A requested change is not effective until Maine Lobster Now confirms it.
Cancellation or modification requests received less than 24 hours before the scheduled shipment date are not guaranteed and may be denied when sourcing, processing, packing, labeling, or other fulfillment activity has begun.
Special seasonal or holiday deadlines disclosed at checkout or in the order confirmation apply to the affected order.
Approved cancellations will be refunded to the original payment method. An order cannot be canceled after it has been transferred to the shipping carrier.
4. Product Availability, Substitutions, and Promotions
If an invoiced product becomes unavailable before shipment, Maine Lobster Now will attempt to contact the Purchaser using the contact information supplied with the order.
Maine Lobster Now will not make a materially different substitution without the Purchaser’s approval.
A substitution may be made without additional approval when:

The Purchaser previously authorized substitutions; or
-
The substitute is not materially different and is of equal or greater value.
If the Purchaser cannot be reached and an appropriate substitution is not authorized, Maine Lobster Now may remove and refund the unavailable product to the original payment method.
If Maine Lobster Now cannot ship an order within the promised timeframe, we will provide any delay notice, cancellation opportunity, or refund required by applicable law.
Promotional and discount codes must be entered during checkout unless the applicable promotion states otherwise. Promotions generally cannot be applied retroactively or combined unless expressly permitted.
Complimentary and promotional products are subject to availability. A complimentary item is not guaranteed unless it appears in the cart, order confirmation, or invoice. The unavailability of a free promotional item does not create a right to a cash refund unless the promotion expressly states otherwise.
5. Payment and Fraud Prevention
Payments are processed through authorized third-party payment-service providers.
Maine Lobster Now does not directly store complete payment-card numbers or card-security codes. Customers may separately elect to store payment credentials with a supported payment wallet or payment provider under that provider’s own terms and privacy practices.
Maine Lobster Now will not request that a customer send a complete payment-card number, card-security code, or photograph of a payment card through email, customer-service messaging, or the Claims Portal.
Maine Lobster Now may review an order for fraud, unauthorized payment activity, identity concerns, address inconsistencies, or other transaction risk. We may:

Place the order on hold;
-
Contact the Purchaser;
-
Request reasonable identity or billing-address verification;
-
Require a replacement order using a verified payment method; or
-
Cancel and refund the order when the risk cannot reasonably be resolved.
Verification information may include government-issued identification or proof of billing address when reasonably necessary. Verification information is used for fraud prevention, transaction verification, dispute handling, legal compliance, and protection of Maine Lobster Now and its customers—not for advertising.
Access to verification information is limited to personnel and service providers with a legitimate need to review it.
Wholesale transactions may be governed by separate written wholesale terms. Maine Lobster Now does not impose a credit-card or debit-card surcharge.
6. Sales and Use Tax
Maine Lobster Now calculates, collects, and remits sales, use, and similar taxes when required by applicable law.
Taxability and tax rates may vary based on the products purchased, services provided, and delivery jurisdiction.
When Maine Lobster Now is not required to collect a particular tax, the Purchaser may be responsible for any use tax or similar obligation imposed directly on the Purchaser by the applicable jurisdiction.
The Purchaser is responsible for supplying accurate information needed to calculate applicable taxes and for providing valid exemption or resale documentation when requesting tax-exempt treatment.
7. Gift Cards and Store Credit
Purchased Gift Cards
Purchased Maine Lobster Now gift cards do not expire and are not subject to dormancy fees.
Gift cards may be used toward eligible products, shipping charges, and applicable taxes but may not be used to purchase another gift card.
Gift cards are not redeemable for cash except where required by applicable law.
If a gift card does not cover the full order total, the remaining balance must be paid using another accepted payment method. Any unused balance remains available under the original gift-card code.
Store Credit
Store credit issued by Maine Lobster Now expires 180 days after its issuance date unless a later expiration date is stated when the credit is issued or applicable law requires otherwise.
The expiration date will be disclosed when the store credit is issued.
Store credit:
-
Is not a purchased gift card;
-
Is not redeemable for cash except where required by law; and
-
May not be used to purchase gift cards.
Store credit issued as a discretionary accommodation, promotional benefit, or remedy under the Maine Lobster Now Delivery Guarantee is governed by the expiration date disclosed when it is issued.
When a refund to the original payment method is required by law, Maine Lobster Now will not substitute store credit without the Purchaser’s agreement.
8. Shipping and Delivery
Shipping availability, carrier services, shipping charges, surcharges, delivery dates, and product or destination restrictions are shown at checkout or in the order confirmation. They may vary based on the products, address, delivery date, and carrier.
Maine Lobster Now may decline or cancel shipment to a destination or address that cannot lawfully or reliably receive the applicable products.
A tracking number will ordinarily be provided after the carrier receives or scans the shipment. Tracking estimates are not guarantees of a particular delivery time.
A package delivered by 10:00 p.m. local time on the scheduled delivery date is considered delivered on time.
Shipping carriers may leave a package in a location they reasonably consider safe without obtaining a signature, knocking, or ringing a doorbell.
If the carrier cannot safely release a shipment, it may attempt redelivery or hold the package for pickup. The Purchaser and Recipient are responsible for monitoring tracking and following carrier instructions.
Addresses, Holds, and Rerouting
The Purchaser must provide a complete and deliverable shipping address, including any apartment, unit, gate code, business name, or access information needed for delivery.
Address changes may be requested before the order has been packed or tracking information has been issued, but changes are not guaranteed. Additional charges may apply.
Customer-requested rerouting after shipment is generally unavailable because the products are perishable.
When operationally possible, Maine Lobster Now may arrange:
-
An address correction;
-
A carrier hold; or
-
Pickup at an authorized carrier location.
Carrier identification requirements and additional charges may apply.
Maine Lobster Now is not responsible for a delay or delivery failure caused by:
-
Inaccurate, incomplete, or undeliverable address information;
-
A restricted address or destination;
-
A closed or inaccessible business;
-
Recipient unavailability;
-
Failure to retrieve a carrier-held package; or
-
A customer-requested hold, correction, pickup, or rerouting request.
9. Maine Lobster Now Delivery Guarantee
The Maine Lobster Now Delivery Guarantee is included with eligible perishable shipments at no additional charge. It is a contractual service commitment and is not an insurance product.
Maine Lobster Now uses commercially reasonable efforts to ship orders for delivery on the date selected at checkout. Exact delivery times are not guaranteed.
Covered Carrier Events
Subject to the exclusions and claim requirements below, the Delivery Guarantee applies when an order is delivered one or more calendar days after its scheduled delivery date because of a carrier:

Sorting error;
-
Mechanical failure;
-
Missed carrier connection;
-
Misrouting event;
-
Carrier-confirmed loss; or
-
Comparable documented carrier operational failure.
Weather and Other Excluded Events
The Delivery Guarantee does not cover delays, loss, or product deterioration caused by:
-
Weather;
-
Natural disasters;
-
Government action;
-
Emergency conditions;
-
Transportation embargoes;
-
Widespread carrier disruptions caused by events outside the carrier’s reasonable control; or
-
Similar events outside the reasonable control of Maine Lobster Now and the carrier.
No refund, replacement, or store credit is provided under the Delivery Guarantee for a weather-related or other excluded event, except where required by law.
Maine Lobster Now may provide a discretionary accommodation. A discretionary accommodation:
-
Is not required;
-
Does not amend these Terms;
-
Does not establish that the event was covered; and
-
Does not require Maine Lobster Now to provide the same accommodation in another matter.
Covered Packages Delivered Late
When an order is delivered one or more calendar days late because of a covered carrier event, the Recipient must:
-
Accept the package;
-
Inspect and appropriately store the products;
-
Avoid consuming any product that appears unsafe; and
-
Submit a claim through the Claims Portal within four hours after the carrier-recorded delivery time.
An approved claim based on a covered carrier delay will ordinarily be resolved through store credit for the value of products materially affected by the delay.
Products that remain safe, usable, and materially consistent with the order are not considered affected solely because delivery occurred late.
On-Time Packages With a Temperature Concern
A package delivered on its scheduled delivery date is not considered a carrier-delay claim merely because a product feels warm.
A customer reporting an unsafe product temperature must submit a product-condition claim within four hours after the carrier-recorded delivery time.
The claim must include a clear photograph showing a food thermometer measuring the affected product in accordance with the Claims Portal instructions.
The reported temperature will be considered together with:
-
Product type;
-
Packaging condition;
-
Presence of ice crystals or refrigerant;
-
Delivery circumstances; and
-
Other supporting information.
A temperature reading does not automatically establish eligibility for compensation.
Packages That Have Not Arrived
If an order has not been delivered by 10:00 p.m. local time on the scheduled delivery date, the Purchaser should continue monitoring carrier tracking.
A formal non-delivery claim may be opened after 10:00 p.m. local time on the second calendar day following the scheduled delivery date. A claim may be opened sooner if the carrier confirms that the package is lost.
The non-delivery claim must be submitted no later than seven calendar days after it first becomes eligible to be opened. The customer does not need to possess the package to open a non-delivery claim.
If tracking states that a package was delivered but the Recipient cannot locate it, the issue must be reported within four hours after the carrier’s delivery scan.
If a package is delivered while a non-delivery claim is pending, the Recipient must accept it. Any product-condition evidence must then be submitted within four hours after delivery.
When a shipment is confirmed lost or remains undelivered after the applicable carrier investigation because of a covered carrier event, Maine Lobster Now may initially offer store credit. The Purchaser may instead request:
-
A replacement shipment; or
-
A refund to the original payment method.
Weather-related and other excluded events remain excluded from these remedies except where applicable law requires otherwise.
Saturday, Holiday, and Expedited-Service Fees
When the Purchaser paid a Saturday-delivery fee, holiday surcharge, or similar expedited-service fee and the purchased delivery service was not provided, the applicable fee will be refunded to the original payment method.
The service fee may be refunded even when the underlying delay is otherwise excluded from the Delivery Guarantee.
Delivery Guarantee Exclusions
A claim may be denied when the delay, loss, or failure resulted from:
-
Incorrect or incomplete address information;
-
A closed or inaccessible delivery location;
-
Recipient unavailability;
-
Failure to retrieve a carrier-held package;
-
A customer-requested hold, correction, pickup, or rerouting request;
-
Unauthorized refusal of delivery;
-
Shipment to a disclosed restricted destination;
-
Weather or another excluded event;
-
Failure to submit the claim within the applicable deadline; or
-
Failure to provide reasonably requested documentation.
Nothing in this section limits a right or remedy that cannot lawfully be limited.
10. Claims, Returns, and Remedies
Because Maine Lobster Now sells highly perishable products, products generally cannot be physically returned unless Maine Lobster Now expressly instructs otherwise.
Claims must be submitted through the Claims Portal at:

Four-Hour Claim Deadline
The following visible or reasonably discoverable issues must be reported within four hours after the carrier-recorded delivery time:

Visible package damage;
-
Product-temperature concerns;
-
Missing products;
-
Incorrect products or quantities;
-
Underweight products;
-
Dead or nonresponsive live lobsters;
-
Visible spoilage;
-
Visible product breakage; and
-
A package marked delivered but not located.
Conditions Not Immediately Discoverable
A condition that could not reasonably have been discovered within four hours—for example, a concealed leak, failed seal, or defect discovered only after opening sealed packaging—must be reported within 24 hours after discovery and no later than 48 hours after delivery.
This exception does not cover deterioration or damage resulting from delayed retrieval, storage, thawing, preparation, cooking, or other handling after delivery.
Required Documentation
A claim must include:
-
Order number;
-
Description of the issue;
-
Photographs of the affected product;
-
Photographs of the shipping package, packaging, and label when relevant; and
-
Any temperature, weight, tracking, or other evidence reasonably requested for the claim type.
The customer must preserve the affected products and packaging for a reasonable period when Maine Lobster Now or the carrier requests inspection.
Failure to provide reasonably requested evidence may make the claim ineligible for compensation.
Acceptance of Delivery and Refused Packages
The Recipient must accept delivery even when the package appears delayed, externally damaged, or potentially affected by temperature, unless Maine Lobster Now or the carrier specifically instructs the Recipient not to accept it.
Acceptance means taking possession so that the condition can be documented. It does not require the Recipient to consume or use a questionable product.
Accepting a package does not waive the Purchaser’s right to submit a claim.
An unauthorized refusal may make the order ineligible for a refund, replacement, or store credit because refusal may prevent Maine Lobster Now from inspecting the contents, documenting their condition, or recovering funds through a carrier claim.
Claim Remedies
For an approved claim, Maine Lobster Now may provide:

Store credit;
-
A replacement shipment;
-
A refund to the original payment method;
-
A refund or credit for a price difference; or
-
Another remedy required by applicable law.
The remedy depends on:
-
Type and severity of the issue;
-
Applicable guarantee;
-
Condition and value of affected products;
-
Product availability;
-
Supporting documentation; and
-
Applicable law.
Store credit is the ordinary remedy for products materially affected by a covered carrier delay after the package is delivered.
When a refund is legally required, store credit will not be substituted without the Purchaser’s agreement.
11. Live Lobster Guarantee and Product Issues
Live Lobster Guarantee
Subject to these Terms, live lobsters are guaranteed to arrive alive when delivered on the scheduled delivery date.
A live-lobster claim must be submitted within four hours after delivery and include a clear photograph of the lobster on its back on a flat surface.
The Live Lobster Guarantee does not provide a refund, replacement, or store credit when the lobster’s condition resulted from:
-
A weather-related or other excluded delivery delay;
-
Incorrect or undeliverable address information;
-
Recipient unavailability;
-
Unauthorized refusal;
-
Failure to retrieve the package;
-
Improper storage or handling after delivery; or
-
Failure to submit the claim and required evidence on time.
Maine Lobster Now does not guarantee that a live lobster will survive when kept overnight or stored after delivery.
When a lobster is affected by a covered non-weather carrier delay, the claim will be handled under the Delivery Guarantee and Claims sections.
Missing, Incorrect, and Underweight Products
A missing or incorrect invoiced product must be reported within four hours after delivery.
For an underweight-product claim, the customer must submit a photograph showing the product on an appropriate food scale. Packaging and other non-product materials should not be included in the measured weight unless the product is sold by packaged weight.
When a similar but lower-value product is received, Maine Lobster Now may provide:
-
A refund or store credit for the price difference;
-
A replacement; or
-
Another appropriate remedy.
Product Breakage
Minor breakage of crab legs, lobster legs, or lobster claws that does not create a food-safety concern or materially reduce the edible quantity may not qualify for compensation.
Do not consume live clams, mussels, or oysters with cracked or broken shells. Photograph and report broken live shellfish within the applicable claim period.
A recommendation to discard an item for food-safety reasons does not automatically establish eligibility for compensation. Eligibility depends on the extent of the breakage, affected quantity, order circumstances, and supporting documentation.
12. Frozen, Refrigerated, and Perishable Product Safety
Some partial thawing may occur when frozen and fresh products are shipped together.
If a frozen product still contains ice crystals or measures 40°F or below, it may generally be safely refrozen, although quality or texture may be affected.
If perishable seafood has been above 40°F for two hours or longer, or the amount of time above 40°F cannot be determined, do not consume it. Contact Maine Lobster Now and follow the Claims Portal instructions.
Do not rely solely on appearance, odor, package temperature, or whether a product feels cool when evaluating food safety.
Food-safety guidance does not automatically establish eligibility for a refund, replacement, or store credit.
13. Allergens, Ingredients, and Preparation
Products sold by Maine Lobster Now may contain allergens and other ingredients requiring special attention.
Depending on the product, these may include:
-
Fish;
-
Crustacean shellfish, including lobster, crab, and shrimp;
-
Molluscan shellfish, including clams, mussels, oysters, and scallops;
-
Milk;
-
Wheat;
-
Soy;
-
Egg;
-
Sulfites; and
-
Other allergens or ingredients identified on the product page, ingredient statement, or package label.
Customers must review the current product page, ingredient information, allergen statement, and package label before preparing or consuming a product.
Ingredients, formulations, suppliers, and preparation environments may change.
Products may be manufactured, processed, packed, or stored in facilities that also handle other allergens, as indicated by the applicable product information.
Unless a product is expressly identified as satisfying a specific allergen-control standard, Maine Lobster Now does not represent that the product or handling environment is allergen-free or completely free from cross-contact.
Customers with a food allergy or sensitivity should contact Maine Lobster Now before ordering and should not consume a product when its ingredient or allergen information is missing, damaged, or unclear.
Consuming raw or undercooked seafood may increase the risk of foodborne illness. Pregnant people, young children, older adults, and people with weakened immune systems or certain medical conditions should avoid raw or undercooked seafood and follow the advice of a qualified health professional.
Customers are responsible for following product labels, storage instructions, preparation instructions, and safe food-handling guidance.
14. SMS and RCS Messaging Terms
By opting into Maine Lobster Now’s text-messaging program, the subscriber agrees to receive recurring SMS and RCS messages from or on behalf of Maine Lobster Now at the mobile number provided.
Messages may be sent using automated technology and may include:
-
Offers and promotions;
-
Product announcements;
-
Recommendations;
-
Cart reminders;
-
Order confirmations;
-
Account notices;
-
Shipping and delivery updates; and
-
Customer-service communications.
Consent is voluntary and is not a condition of purchase.
Message frequency varies. Message and data rates may apply.
SMS and RCS are treated as one text-messaging program. An opt-out applies across both channels.
To opt out, text STOP to 40459 or use the unsubscribe option provided in a message, where available. The subscriber may receive one final message confirming the opt-out.

Wireless carriers are not responsible for delayed or undelivered messages.
Subscribers are responsible for providing a valid mobile number and updating their subscription if the number changes.
Maine Lobster Now may change the sending number or short code used for the program and will provide notice where reasonably required.
Information about the collection, use, and disclosure of messaging data appears in the Maine Lobster Now Privacy Policy.
15. Customer Reviews, Photographs, Videos, and Other Content
Customers retain ownership of reviews, photographs, videos, comments, testimonials, and other content they create.
By submitting that content directly to Maine Lobster Now, through a review form that references these Terms, or in response to a Maine Lobster Now request, the customer grants Maine Lobster Now a nonexclusive, worldwide, royalty-free license to:
-
Host, copy, reproduce, and display the content;
-
Edit it for length, formatting, accessibility, or technical presentation without materially changing its meaning;
-
Publish and distribute it;
-
Use it on product pages and other website pages;
-
Use it in email and text-message marketing;
-
Use it on organic social media;
-
Use it in paid digital advertising;
-
Use it in printed materials and public relations; and
-
Use the customer’s first name, last initial, username, general location, image, likeness, or voice when submitted with the content.
When a customer separately authorizes Maine Lobster Now to use social-media content, the same license applies.
The customer represents that:
-
The customer created the content or has permission to submit and license it;
-
The content does not infringe another person’s rights;
-
The customer has permission from every identifiable person shown or heard in the content; and
-
When a minor appears in the content, the customer is the minor’s parent or guardian or has obtained appropriate permission.
Maine Lobster Now may decline, remove, or stop using content at its discretion.
A customer may request that Maine Lobster Now stop future use of submitted content. Such a request does not require Maine Lobster Now to recall, destroy, or withdraw materials already produced, distributed, published, or committed to publication, except where applicable law requires otherwise.
Photographs, videos, identification documents, and other materials submitted solely for an order claim, fraud review, or identity-verification purpose are not licensed for advertising or promotional use unless the customer separately consents.
16. Intellectual Property
Unless otherwise stated, the Maine Lobster Now name, trademarks, service marks, logos, emblems, photographs, videos, graphics, recipes, written content, product descriptions, website design, packaging, downloadable materials, and other content are owned by or licensed to Maine Lobster Now and are protected by applicable intellectual-property laws.
No person may copy, modify, reproduce, republish, distribute, display, sell, license, scrape, systematically extract, or commercially exploit Maine Lobster Now content without prior written permission, except as expressly permitted by law.
Maine Lobster Now content may not be used to create or populate a competing commercial product, service, catalog, database, website, advertising campaign, artificial-intelligence system, or machine-learning dataset without prior written authorization, except where such restriction is prohibited by law.
The Maine Lobster Now emblem and logo may not be altered or used for unofficial purposes without specific authorization.
Use of the website or purchase of a product does not grant any ownership or license right in Maine Lobster Now intellectual property.
17. Express Guarantees, Warranties, and Limitation of Liability
Maine Lobster Now provides the express guarantees specifically stated in these Terms, an applicable product description, or at checkout, including the Live Lobster Guarantee and Delivery Guarantee where applicable.
Nothing in these Terms excludes, limits, or modifies an implied warranty, statutory remedy, or consumer right that cannot lawfully be excluded, limited, or modified.
To the fullest extent permitted by applicable law, Maine Lobster Now will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including loss of profit, revenue, business opportunity, use, or anticipated savings, arising from an order, product, delivery, website use, or service.
For a claim not involving death, personal injury, damage to tangible property, fraud, gross negligence, willful misconduct, breach of a nonwaivable warranty, violation of a nonwaivable consumer right, or liability that otherwise cannot lawfully be limited, Maine Lobster Now’s aggregate liability will not exceed the amount paid for the order giving rise to the claim.
These limitations do not reduce or replace a remedy expressly available under the Live Lobster Guarantee, Delivery Guarantee, or applicable law.
No employee, contractor, or customer-service representative may create an additional warranty or expand an existing guarantee unless the commitment is confirmed in writing by an authorized Maine Lobster Now representative.
18. Events Outside Reasonable Control
Maine Lobster Now is not responsible for a failure or delay caused by an event outside its reasonable control, including:

Severe weather;
-
Natural disasters;
-
Government action;
-
Transportation disruption;
-
Labor interruption;
-
Utility or telecommunications failure;
-
Public-health emergency;
-
Carrier-network disruption;
-
Civil disturbance; or
-
A similar event outside Maine Lobster Now’s reasonable control.
This section does not eliminate an express remedy that applies under the Delivery Guarantee or a customer right that cannot lawfully be waived.
A discretionary accommodation does not amend these Terms or require Maine Lobster Now to provide the same accommodation in another matter.
19. Electronic Communications and Changes to These Terms
The Purchaser agrees that Maine Lobster Now may provide order confirmations, notices, disclosures, shipping information, and other communications electronically, except where law requires another method.
Electronic acceptance, records, and communications have the same effect as written acceptance and paper records to the extent permitted by law.
Maine Lobster Now may update these Terms from time to time. The updated version will identify its effective date and will be posted on the Maine Lobster Now website.
Unless applicable law requires otherwise or the Purchaser expressly agrees, a material change will apply prospectively to orders placed on or after the updated effective date.
20. Entire Agreement, Severability, and No Waiver
These Terms, the Privacy Policy, applicable checkout disclosures, product-specific terms, promotion terms, and order confirmation constitute the agreement relating to the applicable order.
A specific product, promotion, guarantee, or checkout term controls over a general provision only to the extent of a direct conflict concerning that subject.
The order confirmation controls the products, quantities, prices, Recipient information, shipping address, and delivery date for an individual order, subject to correction of an error and the Order Acceptance section.
If a provision of these Terms is held invalid, illegal, or unenforceable, the remaining provisions will remain effective to the fullest extent permitted by law.
An invalid or unenforceable provision will be interpreted or limited as closely as legally permitted to accomplish its intended purpose.
A failure or delay by Maine Lobster Now in enforcing a provision does not waive that provision or the right to enforce it later.
A waiver is effective only when made in writing by an authorized Maine Lobster Now representative and applies only to the circumstances identified in the writing.
21. Governing Law and Venue
Except where prohibited by applicable law, these Terms and transactions with Maine Lobster Now are governed by the laws of the State of Maine, without regard to conflict-of-law principles.
Except where applicable law permits or requires another forum, a legal action arising from these Terms or an order must be brought in an appropriate state or federal court located in Maine.
Nothing in this section prevents a consumer from exercising a right that cannot lawfully be waived or restricted.
